I. DEFINITIONS

1. customer

A natural person, a legal person or an organizational unit that is not a legal person, to which special laws grant legal capacity, who makes an Order from the Store;

2 Civil Code

3 Regulations

These Regulations for the provision of services by electronic means within the STUKAPUKA.COM online store;

4. online store (Store)

Serwis internetowy dostępny pod adresem https://www.stukapuka.com/, za pośrednictwem którego Klient może składać Zamówienia;

5. goods

Products presented in the Online Store;

6. sales contract

Agreement for sale of Goods in the meaning of the Civil Code, concluded between STUKAPUKA.COM and the Customer, concluded using the Store's website;

7 Consumer Rights Act

Law of May 30, 2014 on consumer rights (Journal of Laws of 2014, item 827);

8. the Law on Provision of Electronic Services

Act of July 18, 2002 on the provision of electronic services (Journal of Laws No. 144, item 1204, as amended);

9 Order

The Customer's statement of intent, aimed directly at concluding the Sales Agreement, specifying in particular the type and number of Goods.

II. GENERAL PROVISIONS

1. Niniejszy Regulamin określa zasady korzystania ze sklepu internetowego dostępnego pod adresem https://www.stukapuka.com/.

(2) These Rules and Regulations are the rules and regulations referred to in Article 8 of the Law on Provision of Electronic Services.

3. Sklep internetowy STUKAPUKA.COM, działający pod adresem https://www.stukapuka.com/, prowadzony jest przez Stuka Puka Sp. z o. o. Za ogrodem 10. 31-990 Kraków. NIP: 6783189725

(4) These Regulations set forth, in particular:
- rules for registration and use of an account within the Online Store;
- the terms and conditions for placing Electronic Orders within the Online Store;
- principles of concluding Sales Contracts using the services provided within the Online Store.

(5) The use of the online store is possible provided that the ICT system used by the Customer meets the following minimum technical requirements: a device with Internet access.

(6) In order to use the online store, the customer should on his own access to a computer workstation or terminal device, with access to the Internet.

(7) In accordance with applicable laws, STUKAPUKA.COM reserves the right to limit the provision of services through the Online Store to persons 18 years of age or older. In such case, potential Customers will be notified of the above.

III. RULES OF USING THE ONLINE STORE

(1) Registration within the Online Store is optional. A customer may place an order without registering with the Store, after reading and accepting these Regulations.
Registration takes place by completing and accepting the registration form, made available on one of the pages of the Store.
Registration is conditional on agreeing to the content of the Regulations and providing personal data marked as mandatory.
STUKAPUKA.COM may deprive the Client of the right to use the Online Store, in particular, when the Client:
- provided during registration in the online store data that are untrue, inaccurate or outdated, misleading or violating the rights of third parties,
- has committed, by means of the online store, a violation of the personal rights of third parties, in particular the personal rights of other Customers of the online store,
- commits any other behavior that will be considered by STUKAPUKA.COM as inconsistent with applicable laws or general rules of Internet use.

(2) In order to ensure the security of the transmission of messages and data in connection with the services provided on the Website, the Online Store shall take technical and organizational measures appropriate to the degree of security threat to the services provided, in particular, measures to prevent unauthorized persons from obtaining and modifying personal data transmitted over the Internet.

(3) In particular, the customer shall:
- not to provide or transmit content prohibited by law, e.g. content that promotes violence, defamatory or violates personal rights and other rights of third parties,
- use the Online Store in a manner that does not interfere with its operation, in particular through the use of specific software or devices,
- not to undertake actions such as: sending or posting unsolicited commercial information (spam) within the scope of the Internet Shop,
- to use the Internet Shop in a manner not disruptive to other clients and STUKAPUKA.COM,
- use of any content placed within the scope of the Internet Shop only for own personal use,
- use the Internet Shop in a manner compliant with the provisions of the law in force on the territory of the Republic of Poland, provisions of the Regulations, as well as with the general rules of Internet use.

IV. PROCEDURE FOR CONCLUDING A SALES CONTRACT

1. W celu zawarcia Umowy sprzedaży za pośrednictwem Sklepu internetowego należy wejść na stronę internetową https://www.stukapuka.com/, dokonać wyboru, podejmując kolejne czynności techniczne w oparciu o wyświetlane Klientowi komunikaty oraz informacje dostępne na stronie.

(2) The selection of ordered Goods by the Customer is made by adding them to the shopping cart.

(3) In the course of placing an Order - until pressing the button confirming the placement of the Order - the Customer has the opportunity to modify the entered data and in the selection of Goods. In order to do so, follow the messages displayed to the Customer and the information available on the site.

(4) After the Customer using the Online Store has provided all necessary data, a summary of the Order placed will be displayed. The summary of the submitted Order will include, among other things, a description of the selected goods or services, the total price and all other costs.

(5) In order to send an Order, it is necessary to accept the content of the Regulations, provide personal data marked as mandatory and press the button confirming the Order.

(6) Information about the Goods given on the Store's websites constitutes an offer, within the meaning of Article 66 of the Civil Code. Sending an Order by the Customer constitutes a statement of will to conclude a Sales Agreement with STUKAPUKA.COM, in accordance with the content of the Regulations.The contract is considered concluded at the moment when the Customer's Order is received by the IT system of the Online Store, provided that the Order complies with the Regulations. After concluding the contract, the Customer receives an e-mail message containing confirmation of all significant elements of the Order.

7 The sales contract shall be concluded in the Polish language, with the content in accordance with the Regulations.

V. SUPPLY

(1) Delivery of Goods is limited to the European Union except for the countries: Cyprus, Malta, Portugal, Croatia, and shall be made to the address indicated by the Customer when placing the Order.

(3) The delivery period is a maximum of 2 working days from the shipment of the package and is calculated from the day the Customer sends the Order.

4. Klienci mogą uzyskać dostęp do niniejszego Regulaminu w każdym czasie za pośrednictwem odsyłacza zamieszczonego na stronie głównej serwisu https://www.stukapuka.com/ oraz pobrać go i sporządzić jego wydruk.
Utrwalenie, zabezpieczenie, udostępnienie oraz potwierdzenie Klientowi istotnych postanowień Umowy sprzedaży Towarów następuje poprzez przesłanie Klientowi na podany adres e-mail oraz poprzez dołączenie do przesyłki zawierającej Towar wydruku potwierdzenia, specyfikacji Zamówienia oraz faktury VAT.

VI. PRICES AND PAYMENT METHODS

1 The prices of the Goods are given in Polish zloty and include all components, including VAT, customs duties and any other components.

VIII. COMPLAINTS REGARDING GOODS

(1) STUKAPUKA.COM as a seller is liable to the Customer who is a consumer within the meaning of Article 22[1] of the Civil Code, on account of warranty for defects to the extent specified in the Civil Code, in particular in Article 556 and Article 556[1]-556[3] of the Civil Code.

(2) Complaints arising from violation of the Customer's rights guaranteed by law, or under these Regulations, should be addressed to the address: Bandtkiego 19/3 30-129 Kraków. STUKAPUKA.COM undertakes to consider each complaint within 14 days, and if this is not possible, to inform the Client within this period when the complaint will be considered.

IX. COMPLAINTS REGARDING PROVISION OF SERVICES BY ELECTRONIC MEANS

1. STUKAPUKA.COM takes steps to ensure fully correct operation of the Store, to the extent that results from current technical knowledge, and undertakes to remove within a reasonable time any irregularities reported by the Customers.

(2) The Customer is obliged to immediately notify STUKAPUKA.COM of any irregularities or interruptions in the functioning of the Online Store service.

(3) Irregularities related to the functioning of the Store Customer can be reported in writing to the address: Bandtkiego 19/3 30-129 Kraków or by email to: info@stukapuka.com

(4) In a complaint, the customer should provide his name, mailing address, type and date of occurrence of irregularities related to the operation of the Store.

(5) STUKAPUKA.COM undertakes to consider each complaint within 14 days, and if this is not possible, to inform the Client within this period when the complaint will be considered.

X. FINAL PROVISIONS

(1) Settlement of potential disputes arising between STUKAPUKA.COM and the Customer, who is a consumer within the meaning of Article 22[1] of the Civil Code, shall be submitted to the competent courts in accordance with the provisions of the relevant provisions of the Civil Procedure Code.

(2) Settlement of potential disputes arising between STUKAPUKA.COM and the Client, who is not a consumer within the meaning of Article 22[1] of the Civil Code, shall be submitted to the court having jurisdiction over the seat of STUKAPUKA.COM.

(3) Matters not covered by these Regulations shall be governed by the provisions of the Civil Code, the provisions of the Act on Rendering Electronic Services and other relevant provisions of Polish law.
